RANCHI, India, Sept. 24 -- Jharkhand High Court issued the following order on Aug. 25:
Heard the learned counsel for the respective sides.
This appeal is directed against the order dated 02.07.2025 passed in M.C.A. No. 1606 of 2025 arising out of S.T. Case No. 58 of 2025 (Haidernagar P.S. Case No. 52/2024 by the learned Additional Sessions Judge-III, Palamau at Daltonganj, whereby and whereunder, the prayer for bail of the appellant has been rejected.
It has been alleged that some extremists had come to the site of M/s. Abhay Enterprises and had set ablaze JCB vehicles as well as tractors.
Submission has been advanced by the learned counsel for the appellant that the appellant is not named in the First Information Report and has been implicated on self-confession rendered in Hussainabad P.S. Case No. 288 of 2023. It has been submitted that the appellant is in custody since 22.08.2024 and one of the co-accused has granted bail by a Coordinate Bench of this Court in Criminal Appeal (DB) No. 1120 of 2024.
Mr. Shailesh Kumar Sinha, learned APP has opposed the prayer for bail of the appellant and has submitted that the appellant has got several criminal antecedents.
However, regard being had to the manner of implication of the appellant and the fact that one of the co-accused has been granted bail as noted above, we while setting aside the order dated 02.07.2025 passed in M.C.A. No. 1606 of 2025 arising out of S.T. Case No. 58 of 2025 (Haidernagar P.S. Case No. 52/2024 by the learned Additional Sessions Judge-III, Palamau at Daltonganj, direct that the appellant be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-III, Palamau at Daltonganj in connection with of S.T. Case No. 58 of 2025 (Haidernagar P.S. Case No. 52/2024).
This appeal is allowed.
