RANCHI, India, Nov. 19 -- Jharkhand High Court issued the following order on Oct. 29:

1. Heard learned counsels for petitioners and for State.

2. Petitioners are apprehending their arrest in connection with Barkagaon PS (Sikri O.P)Case No.194 of 2025, for offence registered under section 317(2) of BNS, 2023, section 4/21 of Mines and Mineral (Development and Regulation) Act, Rule 54 of Jharkhand Minor Mineral Concession Rules, 2004,Rule 9/13 of Jharkhand Minerals (Prevention of Illegal Mining, Transportation and Storage) Rules,2017, pending before learned J.M.F.C., Hazaribag.

3. Learned counsel for petitioners submits that six tractors have been seized by police on allegation that illegally the sand was being loaded on said tractors. He further submits that the petitioners are owner cum driver of the two of the tractors and in the seizure list, the quantity of the sand is not disclosed.

4. Learned State counsel opposes prayer and submits that said tractors have been seized along with illegally loading of sand.

5. Considering that petitioners are owner cum driver of the two of the tractors and in the seizure list, the quantity of the sand is not disclosed, I am inclined to grant anticipatory bail to petitioners.

6. Accordingly, both the petitioners, above named, are hereby directed to surrender before learned court within three weeks from today, and in event of their surrender/arrest, petitioners, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each, with two sureties of like amount each, to satisfaction of learned J.M.F.C., Hazaribag, in connection with Barkagaon PS (Sikri O.P) Case No.194 of 2025, subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023.
