Heard the learned counsel for the respective parties.

This application has been preferred by the appellant for condoning a delay of 36 days in filing the appeal.

Having been satisfied with the reasons assigned in this application, the delay of 36 days which had occurred in filing this appeal is condoned and this I.A. is allowed and disposed of.

Criminal Appeal (DB) No. 477 of 2025

Heard the learned counsel for the respective sides.

This appeal is directed against the order dated 17.12.2024 passed in B.P. No. 791 of 2024 in connection with Basia P.S. Case No. 75/2024 by the learned Sessions Judge, Gumla, whereby and whereunder, the prayer for bail of the appellant has been rejected.

It has been alleged that on a raid conducted in the house of the appellant several incriminating articles were recovered which would indicate that the appellant was involved in manufacturing arms.

Learned counsel for the appellant submits that he is in custody since 30.10.2024. It has further been submitted that the appellant is a polio patient and he is not able to walk properly.

Learned Spl.PP has opposed the prayer for bail of the appellant.

Regard being had to the period of custody undergone by the appellant, we while setting aside the order dated 17.12.2024 passed in B.P. No. 791 of 2024 in connection with Basia P.S. Case No. 75/2024 by the learned Sessions Judge, Gumla, direct that the appellant be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like mount each to the satisfaction of learned Additional Chief Judicial Magistrate, Gumla in connection with Basia P.S. Case No. 75/2024.

This appeal is allowed.
