RANCHI, India, June 16 -- Jharkhand High Court issued the following order on May 14:
1. Heard learned counsels for petitioner and for State.
2. The petitioner is apprehending his arrest in connection with Poraiyahat PS Case No.42 of 2024, for offence registered under section 272, 273, 34 of IPC and Section 47(a) of Jharkhand Excise Act, 1915, pending in court of learned S.D.J.M., Godda.
3. Learned counsel for petitioner submits that the name of the petitioner has come on confessional statement of the apprehended co-accused from whose possession foreign liquor has been recovered. He next submits that the petitioner has got no criminal antecedent as disclosed in paragraph no.14 of the petition.
4. Learned State counsel opposes prayer and submits that the name of the petitioner has come on confessional statement of the apprehended co-accused.
5. Considering that name of the petitioner has come on confessional statement of the apprehended co-accused and the petitioner has got no criminal antecedent as aforesaid, I am inclined to grant anticipatory bail to the petitioner.
6. Accordingly, the petitioner, above named, is hereby directed to surrender before learned court within two weeks from today, and in event of his surrender/arrest, the petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of like amount each, to the satisfaction of learned S.D.J.M., Godda, in connection with Poraiyahat PS Case No.42 of 2024, subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023.
