RANCHI, India, April 7 -- Jharkhand High Court issued the following order on March 9:

1. Heard the learned counsel representing the petitioner and the learned counsel representing the respondents.

2. The petitioner claims the benefit of ACP and MACP which according to the petitioner has not been considered by the respondents, though representation has been filed by the petitioner.

3. Learned counsel for the petitioner submits that the petitioner has worked for 35 years without ACP and MACP and his representation is already pending before the respondents, suffice it would be, if a direction is given to the respondents to consider the claim of the petitioner.

4. Learned counsel appearing on behalf of the respondents submits that if the petitioner files a detailed fresh representation before the respondent no. 2-the Director General of Police, his case will be considered and appropriate order will be passed.

5. Considering the submission of the parties, I direct the petitioner to file a fresh representation before the respondent no. 2- the Director General of Police who will consider the case of the petitioner or will authorize any competent officer to consider the representation of the petitioner and after considering his representation will pass an appropriate order.

6. If it is found that the petitioner is entitled for ACP and MACP benefits the same will be granted to the petitioner. If the petitioner is entitled for any monetary benefit on revision of the scale the same should also be disbursed to the petitioner thereafter.

7. The entire process should be concluded within ten weeks from the date of receipt of the copy of the fresh representation.

8. With the aforesaid observation and direction, this writ petition is disposed of.
