RANCHI, India, May 21 -- Jharkhand High Court issued the following order on April 20:
Heard Mr. Pratiush Lala, learned counsel for the appellant and Mr. Satish Prasad, learned A.P.P. for the State.
This application has been preferred against the order dated 13.02.2026 passed by the learned Special Judge, Children's Court, Sahibganj in connection with Criminal Appeal No. 63 of 2025 whereby and whereunder the order dated 17.11.2025 passed by the learned Principal Magistrate, Juvenile Justice Board, Sahibganj in connection with M.C.A. No. 1913 of 2025 rejecting the prayer for bail of the petitioner has been affirmed.
The allegation reveals that the petitioner has tried to commit rape upon the daughter of the informant.
Submission has been advanced by the learned counsel for the petitioner that social investigation report reveals that the petitioner studies in a college along with the victim and there was a love affair between the petitioner and the victim. It has further been submitted that the petitioner is in remand home since 10.10.2025.
On consideration of the period of custody undergone by the petitioner and the fact that social investigation report does suggest that there was a love affair between the petitioner and the victim, while setting aside the order dated 13.02.2026 passed by the learned Special Judge, Children's Court, Sahibganj in connection with Criminal Appeal No. 63 of 2025, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each, to the satisfaction of the Principal Magistrate, Juvenile Justice Board, Sahibganj in connection with Mirzachowki P. S. Case No. 71 of 2025, subject to the condition that the mother of the petitioner shall ensure the welfare of the petitioner and she shall ensure that the petitioner is kept away from anti-social elements.
This application is allowed.
