RANCHI, India, April 9 -- Jharkhand High Court issued the following order on March 9:

1. Heard learned counsel appearing on behalf of Petitioner and learned counsel appearing on behalf of the State.

2. The petitioner is apprehending his arrest arrested in connection with Deori P.S. Case No. 150 of 2023, for the offence registered under Sections 414, 467, 468, 471, 420/34 of the Indian Penal Code and under section 30 (ii) Coal Mines Act, pending in the Court of Learned Judicial Magistrate, First Class, Giridih.

3. Learned counsel appearing for the petitioner submits that petitioner happened to be the proprietor of Shree Shyam Udyog and the allegations are made that from the petitioner's firm, the coal was being transported. He submits that the owner of the truck has been granted anticipatory bail by the learned Sessions Judge in ABP No. 17 of 2024. He also submits that in the order of learned Sessions Judge, it has come that till date, the Investigating Officer is not able to verify the document seized by the police, which was produced by the driver of the said truck.

4. Learned counsel appearing for the State opposed the prayer and submits that the coal was being transported in absence of any valid challan.

5. Considering that the only allegation against the petitioner is that from the firm of the petitioner, the coal was loaded and the owner of the said truck, on which the alleged coal was loaded, has been granted anticipatory bail by the learned Sessions Judge in ABP No. 17 of 2024, in that view of the matter, the petitioner above named is directed to surrender before the learned Court within two weeks and the learned Court shall release the petitioner on such terms and condition and sureties, the learned Court may deem fit and proper.
