RANCHI, India, May 7 -- Jharkhand High Court issued the following order on April 6:

1. Heard learned counsel for the parties.

2. The instant writ application has been preferred by the petitioner for the following reliefs;

(i) For issuance of an appropriate writ(s)/order (s)/direction(s) or a writ in nature of mandamus commanding upon the respondents to fix pay as per 5th and 6th pay revision and revise salary/pension as petitioner's name is absent in the pay revision chart. AND

(ii) For issuance of an appropriate writ(s)/order (s)/direction(s) or a writ in nature of mandamus commanding upon the respondents to allow time bound promotion to the petitioner and revise salary/pension/retiral benefits in consequent to it.

(iii) For issuance of an appropriate writ(s)/order (s)/direction(s) or a writ in nature of mandamus commanding upon the respondents to pay the accumulated arrear of the 5th and 6th pay revision with appropriate interest. AND

(iv) For issuance of an appropriate writ(s)/order (s)/direction(s) or a writ in nature of mandamus commanding upon the respondents to revise the salary/pension/retiral benefits of the petitioner as these have been fixed at reduced rate.

AND/OR

Pass such other order or orders as Your Lordships may deem fit and proper in the facts and circumstances of this case.

3. Learned counsel for the petitioner submits that, though the petitioner is entitled for revision of salary/pension as per the 5th and 6th pay revision, however, respondents are sitting tight over of the matter.

4. Learned counsel for the University submits that the case of the petitioner has been duly recommended to the State-Government on 06.03.2024. However, learned counsel for the State seeks adjournment as a counter-affidavit is being prepared and further prays for one week's time.

5. As aforesaid, the recommendation of the University has been made in the year 2024, and still the State Government is sitting tight over the matter; as such interest of justice would be sufficed by directing the concerned respondent to do the needful.

6. Accordingly, the instant writ application stands disposed of by directing the State Government to take a final decision on the recommendation made by the University and pass an order with regard to revision of salary on the basis of 5th and 6th pay revision within a period of 8 weeks from the date of receipt of copy of this order and thereafter, the University shall disburse the amount after receiving the fund.

7. Consequently, the instant writ application stands disposed of. Pending I.As, if any, also stands disposed of.
