Heard Mr. Shailesh Kr. Singh, learned counsel for the appellant, and learned counsel for the State.

This application has been preferred by the appellant for condoning a delay of 24 days in filing the appeal.

Having been satisfied with the reasons assigned in this application, the delay of 24 days, which had occurred in filing this appeal, is condoned and this I.A. is allowed and disposed of.

Cr. Appeal (D.B.) No. 1394 of 2025

Heard the learned counsel for the respective sides.

This appeal is directed against the order dated 20.08.2025 passed by learned Additional Sessions Judge-XVI, Dhanbad in B.P. No. 755 of 2025 in connection with Barwadda P.S. Case No. 156/2025, whereby and whereunder, the prayer for bail of the appellant has been rejected.

It has been alleged that in course of checking, two persons were apprehended by the police and on their disclosure, four other persons were also apprehended with arms and ammunitions.

Submission has been advanced by learned counsel for the appellant that no incriminating article was recovered from the possession of the appellant. It has further been submitted that the appellant is in custody since 02.08.2025. Learned counsel adds that some of the co-accused have been granted bail by a Co-ordinate Bench of this Court in Cr. Appeal (DB) Nos. 1187 of 2025 and 1138 of 2025 vide order dated 07.10.2025.

Learned counsel for the State though opposed the prayer for bail, but has not disputed the aforesaid contention.

Regard being had to the above, we while setting aside the order dated 20.08.2025 passed by learned Additional Sessions Judge-XVI, Dhanbad in B.P. No. 755 of 2025 in connection with Barwadda P.S. Case No. 156/2025, direct that the appellant, named above, be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Dhanbad in connection with Barwadda P.S. Case No. 156/2025.

This appeal is allowed.
