RANCHI, India, Nov. 30 -- Jharkhand High Court issued the following order on Oct. 30:
1. Heard learned counsel appearing on behalf of Petitioner and learned counsel appearing on behalf of the State.
2. The petitioner is apprehending her arrest in connection with Katkamdag P.S. Case No.-199 of 2024 for the offence registered under sections 126, 115(2), 117(2), 89, 3(5) of B.N.S., 2023, pending in the court of learned Judicial Magistrate, Hazaribagh. 1st Class, Hazaribagh.
3. Learned counsel appearing for the petitioner submits that the petitioner is the married sister-in-law of the informant and the allegation are there of miscarriage and there are general and omnibus allegation against all the family members. He also submits that the mother-in-law and aunt-in-law have been granted anticipatory bail in ABA No.825 of 2025 by order dated 07.02.2025.
4. Learned counsel for the State opposed the prayer and submits that allegations are there against all the accused persons and due to them, the miscarriage occurred.
5. In view of the above and considering that the petitioner happened to be sister-in-law of the informant and mother-in-law and aunt-in-law have been granted anticipatory bail in aforesaid ABA, I am inclined to grant anticipatory bail to the petitioner.
6. Accordingly, the petitioner above named is directed to surrender before the learned Court within three weeks from the date of receipt of the order and on the event of her surrender / arrest, she shall be released on bail on furnishing bail bond of Rs.25,000/- (Twenty-Five Thousand) with two sureties of the like amount of each to the satisfaction of learned Judicial Magistrate, Hazaribagh. 1st Class, Hazaribagh, in connection with Katkamdag P.S. Case No.-199 of 2024, subject to the condition as laid down under Section 482(2) of Bhartiya Nagarik Suraksha Sanhita, 2023.
7. This Anticipatory Bail Application is accordingly allowed and disposed of.
