RANCHI, India, Feb. 8 -- Jharkhand High Court issued the following order on Jan. 8:
Heard Mr. Kaushal Kishor Mishra, learned counsel for the appellant and learned A.P.P.
This appeal is directed against the order dated 29.11.2025 passed by the learned Principal Sessions Judge, Jamtara in M.C.A. No. 941/2025 in connection with Nala P.S. Case No. 58/2024, whereby and whereunder, the prayer for bail of the appellant has been rejected.
It has been alleged that pilferage of oil from the pipeline was being done by the accused persons including the present appellant.
Submission has been advanced by the learned counsel for the appellant that the appellant is the owner of the tanker. It has further been submitted that the driver of the tanker has been granted bail by a Co-ordinate Bench of this Court in Cr. Appeal (DB) No. 1513 of 2024. Learned counsel submits that the appellant is in custody since 12.11.2025.
Learned A.P.P. has opposed the prayer for bail of the appellant.
Regard being had to the fact that one of the coaccused has been granted bail by a Co-ordinate Bench of this Court as noted above, we while setting aside the order dated 29.11.2025 passed by the learned Principal Sessions Judge, Jamtara in M.C.A. No. 941/2025 in connection with Nala P.S. Case No. 58/2024 direct that the appellant be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate- 1st Class, Jamtara.
This appeal is allowed.
