RANCHI, India, March 28 -- Jharkhand High Court issued the following order on Feb. 24:

1. Heard the learned counsel representing the petitioner and the learned counsel representing the respondents.

2. The petitioner claims death benefit of late Kunti Mundari who was working as Ward Girl in MGM Hospital, Jamshedpur. She died on 21.11.2022. The petitioner being one of the nephew (brother's son) of the deceased has approached this Court claiming the death benefits.

3. Counter affidavit has been filed by the State. In the counter affidavit in paragraph 8 it has been mentioned that in the year 2000 the deceased employee had nominated five persons to receive the share of the death benefits in equal instalments. Name of the petitioner is missing in the said nomination. Further in paragraph 9 it has been mentioned that in 2007 nomination was changed and mother was nominated to receive 100% benefit. Thereafter in 2015 the nomination of the deceased employee was again modified in her E-service book but the same was not entered and certified in the prescribed format in the physical form by the respondents.

4. Considering the aforesaid fact since there are other legal heir of the deceased also, the petitioner should approach appropriate Civil Court for grant of succession certificate. Once the succession certificate is issued by the competent Court the respondents will disburse the amount of death benefit of late Kunti Mundari in terms of the succession certificate issued by the competent Court.

5. With the aforesaid observation this writ petition is disposed of.
