RANCHI, India, Sept. 2 -- Jharkhand High Court issued the following order on July 1:

Heard Mr. A.K. Chaturvedi, learned counsel for the appellant and Mr. Vishwanath Roy, learned Spl. P.P.

This application has been preferred by the appellant for condoning a delay of 09 days in filing the appeal. Having been satisfied with the reasons assigned in the instant application, the same is allowed and a delay of 09 days in filling the appeal is hereby condoned.

I.A. No. 7786 of 2025 stands disposed of.

Cr. Appeal (DB) No. 760 of 2025.

This appeal is directed against the order dated 01.05.2025 passed by the learned Sessions Judge, Palamau in B.P. No. 208/2025 in connection with AHTU P.S. Case No. 02/2025, whereby and whereunder, the prayer for bail of the appellant has been rejected.

It has been alleged that from the Daltonganj Railway Station, about ten children who were being taken to Delhi by the appellant were intercepted and the appellant was apprehended.

Submission has been advanced by the learned counsel for the appellant that he does not have any criminal antecedent. It has further been submitted that the appellant himself works as a labour in cooler factory in Noida and he had come to his village on account of the illness of his father and all the children who were found accompanying him were being taken to New Delhi for working as a labour in the said cooler factory. Learned counsel adds that the appellant is in custody since 19.03.2025.

Learned Spl. P.P. has opposed the prayer for bail of the appellant.

On consideration of the aforesaid facts and the period of custody undergone by the appellant, we, while setting aside the order dated 01.05.2025 passed by the learned Sessions Judge, Palamau in B.P. No. 208/2025 in connection with AHTU P.S. Case No. 02/2025, direct that the appellant be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Palamau in connection with AHTU P.S. Case No. 02/2025.

This appeal is allowed.
