RANCHI, India, Nov. 2 -- Jharkhand High Court issued the following order on Oct. 6:
1. Heard learned counsels for petitioner and for State.
2. The petitioner is apprehending his arrest in connection with Mirzachouki P.S. Case No.19 of 2025, for offence registered under section 316(2) and 318(4) of BNS, 2023, pending in court of learned Sub Divisional Judicial Magistrate, Sahibganj.
3. Learned counsel for petitioner submits that only allegation is made against petitioner is of introducing the informant along with two other persons namely Sonu, M.K. Mishra as well as Abhay Singh. He further submits that at the time of their meeting, petitioner was not present and amount has been transferred by informant in bank account of M.K. Mishra and Abhay Singh. He submits that nothing has been transferred in bank account of petitioner and petitioner happened to be brother-in-law of informant.
4. Learned State counsel opposes prayer and submits that petitioner has introduced the informant along with other accused persons in whose account the money has been transferred.
5. Considering that amount in question has been transferred in account of Abhay Singh and M.K. Mishra and nothing has been transferred in the account of petitioner, I am inclined to grant anticipatory bail to petitioner.
6. Accordingly, petitioner, above named, is hereby directed to surrender before learned court within three weeks from today, and in event of his surrender/arrest, petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of like amount each, to satisfaction of learned Sub Divisional Judicial Magistrate, Sahibganj, in connection with Mirzachouki P.S. Case No.19 of 2025, subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023.
