RANCHI, India, Oct. 17 -- Jharkhand High Court issued the following order on Sept. 16:
Heard Mr. Ankit Kumar, learned counsel appearing for the appellants and Mrs. Priya Shrestha, learned Special P.P. appearing for the State.
This appeal is directed against the order dated 02.08.2025 passed in B. P. No. 254 of 2025 by the learned Additional Sessions Judge I, Deoghar arising out of Jasidih (Rail) P. S. Case No. 46 of 2025 whereby and whereunder the prayer for bail of the appellants has been rejected.
It has been alleged that 5 children who were being taken to Tamil Nadu were recovered and the appellants were apprehended on the allegation that they were involved in human trafficking.
Submission has been advanced by the learned counsel for the appellants that they are in custody since 31.05.2025. He has also submitted that all the 5 children were recovered from the railway station itself.
Learned Special P.P. for the State has opposed the prayer for bail of the appellant.
On consideration of the fact that the recovery has been effected and the period of custody undergone by the appellant, we while setting aside the order dated 02.08.2025 passed in B. P. No. 254 of 2025 by the learned Additional Sessions Judge I, Deoghar, direct that the appellant above named be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each, to the satisfaction of the learned Railway Judicial Magistrate 1st class, Madhupur in connection with Jasidih (Rail) P. S. Case No. 46 of 2025.
This appeal is allowed.
