RANCHI, India, July 19 -- Jharkhand High Court issued the following order on Jun 18:

1. These anticipatory bail applications under Section(s) 482 and 484 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, have been preferred by the petitioners apprehending their arrest for offences registered under Section(s) 498A, 354 IPC and Sections 3/4 of the Dowry Prohibition Act.

2. Heard the parties at length and had gone through the documents, annexed along with this application.

3. Opportunity was given to the State as well as opposite party No. 2 to oppose the bail, which they availed and opposed.

4. It is alleged that Deepak Gupta (petitioner in ABA No. 7194 of 2024) was married to the opposite party No. 2. it is further alleged that dowry was demanded by inlaw and the informant was tortured and physically assaulted. It is further alleged that one Munsaff Ansari, being the friend of the husband, used to tease the informant and also outrage her modesty.

5. During course of argument, it has been brought to notice of this Court by the parties that in National Lok Adalat, the parties have resolved their dispute. The Principal Judge, Family Court at Chaibasa in Original Suit No. 115 of 2024 vide order dated 29.3.2025 has recorded the terms of settlement. The said order has been produced by the counsel for the petitioners and the same is kept on record.

6. After going through the said order, I find that the dispute has been amicably resolved and the terms of settlement is hereunder:-

"(i) Both parties have amicably resolved their disputes.

(ii) both parties have decided to part their ways permanently.

(iii) It was resolved that there is no possibility to lead conjugal life together.

(iv) It was resolved that both parties shall file a suit for divorce u/s 13B of Hindu Marriage Act within one week on the basis of mutual consent.

(v) It was resolved that Deepak Gupta shall return utensils, cloths, neck-less, ear ring, bangles, and Nathuni (nose ring) to his wife Arti Kumari on or before 16.4.2025.

(vi) It was resolved that both parties shall not interfere in their peaceful life and they shall not file any civil/Criminal case against each other.

(vii) It was resolved that petitioner Deepak Gupta shall pay Rs.6,00,000/- as one time alimony to his wife Arti Kumari within 06

(six) months, out of which, 40% i.e. Rs.2,40,000/- of said amount shall be deposited in the Court through D.D. At the time of admission of Suit.

(viii) It was resolved that the petitioner/wife shall withdraw her cases within 03 months.

(ix) It was resolved that petitioner Arti Kumari shall not claim any movable or immovable property from her husband in future."

7. Considering the aforesaid facts, I am inclined to allow these three anticipatory bail application. Accordingly, the petitioners, above named, are directed to surrender before the court below within four weeks from today and in the event of their surrender/arrest, the court below is directed to enlarge them on bail on furnishing bail bond of Rs.10,000/-(rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM, Chakradharpur, Chaibasa, in connection with Manoharpur P.S. Case No. 22 of 2024, subject to condition that one of the bailers should be close relative of the petitioners and other should be a resident of State of Jharkhand, having sufficient landed property in his/her name or in the name of his/her ancestors in which he/she is having share and to that effect, he/she has to file an affidavit before the Trial Court indicating his/her share in the property.
