RANCHI, India, June 10 -- Jharkhand High Court issued the following order on May 13:
1. Heard Mr. Kripa Shankar Nanda, learned counsel for the petitioner and Mr. Arup Kumar Dey, learned A.P.P. appearing for the State.
2. Petitioner has been made accused in connection with Mandu (WB) P.S. Case No. 226 of 2024 for the offences registered under Section 309(4) of the Bharatiya Nyaya Sanhita (BNS), 2023.
3. There is allegation against this petitioner that he along with other coaccused persons committed robbery and had taken gold items from the house of the informant.
4. Learned counsel for the petitioner has submitted that except the confessional statement, there is no iota of material against this petitioner and other co-accused persons have already admitted to bail.
5. Learned A.P.P. has opposed the prayer for bail on the premise that the petitioner is having three cases to his credit of similar nature.
6. Record reveals that one co-accused namely, Deepak Kumar apprehended in the present case who made disclosure statement on the basis of which gold jewellery has been got recovered from other co-accused namely, Ravindra Soni. The name of this petitioner surfaced in the present case from the mouth of other co-accused persons.
7. It appears that co-accused Deepak Kumar and Ravindra Soni have already been admitted to bail. 8. Considering the facts and circumstances, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs. 25,000/- (Rupees twenty five thousand), with two sureties of the like amount each, to the satisfaction of learned Additional Chief Judicial Magistrate, Ramgarh in connection with Mandu (WB) P.S. Case No. 226 of 2024.
