RANCHI, India, Nov. 2 -- Jharkhand High Court issued the following order on Oct. 6:

1. Heard learned counsel appearing for the petitioner and learned counsel appearing for the State.

2. The petitioner is apprehending his arrest in connection with Siyaljori P.S. Case No.77/2023, registered for the offence under Sections 379, 406, 420 and 34 of the Indian Penal Code, pending in the Court of the learned Judicial Magistrate, 1st Class cum Civil Judge, Jr. Division, Bokaro.

3. Learned counsel appearing for the petitioner submits that the petitioner is not named in the FIR. He further submits that the name of the petitioner has come on the basis of the statement made by other co-accused persons only on the ground that the petitioner has instructed for supply of mixed sub-standard materials. He then submits that the allegations are made that mixed sub-standard coal was supplied to the ESL Plant, Bokaro. He next submits that the petitioner has got no criminal antecedent, as disclosed in paragraph 14 of this application.

4. Learned counsel appearing for the State opposed the prayer and submits that the allegations are there of supply of mixed sub-standard materials.

Considering that the petitioner has got no criminal antecedent and the name of the petitioner has come on the basis of the statements made by other co-accused persons and only allegation is made that mixed substandard of coal was supplied to the said plant and in the attending facts and circumstances of the case, I am inclined to extend the privilege of anticipatory bail to the petitioner.

6. Accordingly, the above-named petitioner is directed to surrender before the learned Court within three weeks from today and in the event of his arrest or surrender, he will be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class cum Civil Judge, Jr. Division, Bokaro in connection with Siyaljori P.S. Case No.77/2023, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
