RANCHI, India, Dec. 26 -- Jharkhand High Court issued the following order on Nov. 26:
1. Heard learned counsel representing the petitioner and learned counsel representing the respondents.
2. At the outset, learned counsel representing the petitioner submits that the second prayer of the petitioner i.e. prayer No. 1(ii), has been considered and rejected, which has now become the subject matter of a different writ petition, thus the petitioner wants to confine this writ petition to prayer Nos.1 (i) & 1 (iii). He further submits that during the nationwide lockdown and Covid period from 23.03.2020 to 10.06.2020, the petitioner could not join his place of posting. He prays that this period be regularized. He further prays that the petitioner is entitled to receive the profit related pay, which has also not been granted to the petitioner, rather not yet been considered. He submits that the respondents be directed to consider the aforesaid two prayers of the petitioner.
3. Learned counsel representing the respondent - Uranium Corporation of India Limited (UCIL), submits that if the petitioner files a fresh representation along with necessary documents in support of his claim, his case can be considered and an appropriate order will be passed.
4. Considering the aforesaid submission, the petitioner is directed to file a fresh representation before the respondent - UCIL, along with all documents, within four weeks.
5. On receipt of such representation, the respondent - UCIL will consider the claim of the petitioner and pass an appropriate order, within six weeks.
6. If the petitioner is found entitled to, his claim shall be extended to him within two weeks thereafter.
7. If any order is passed against the petitioner, the same will be communicated to him within the aforesaid period.
8. Be it noted that I have not gone into the merits of this case.
9. With the aforesaid directions, this writ petition stands disposed of.
