RANCHI, India, Nov. 13 -- Jharkhand High Court issued the following order on Oct. 13:

1. Heard learned counsels for petitioners and for State.

2. The petitioners are apprehending their arrest in connection with Katkamsandi PS Case No.141 of 2025, for offence registered under section 316(4), 318(4), 338, 340, 336(3), 340(2),351(2), 3(5) of BNS, 2023, pending in court of learned Judicial Magistrate, First Class, Hazaribagh.

Learned counsel for petitioners submits that father of the petitioners had purchased two plots in the year 1962 in light of Annexure-2 in which it has been disclosed how the land has been purchased. He then submits that the petitioners have also filed Original Suit No.17 of 2024 for declaration of right, title and interest. He then submits that the FIR has been lodged alleging therein that the petitioners were objecting land possession certificate. He then submits that in view of that, anticipatory bail may kindly be allowed.

4. Learned State counsel opposes prayer and submits that allegations are made of threatening.

5. Learned counsel for the informant has opposed the prayer and submits that suit has already been dismissed. He further submits that there is correspondence with the Circle Officer and Sub Registrar and so far as the claim with regard to the purchase is concerned, that is in relation to another plot and not with regard to this plot and the petitioners are also threatening.

5. Considering that prima facie it transpires that there are two registration deed number disclosed in Annexure 2 of the year 1962 and there is land dispute. In reply to the argument of the learned counsel for the informant, the learned counsel for the petitioners has pointed out that the Original Suit No.17 of 2024 has been restored and the said suit was further posted on 09.10.2025, and in the attending facts and circumstances of the present case, I am inclined to grant anticipatory bail to petitioners.

Accordingly, both the petitioners, above named, are hereby directed to surrender before learned court within three weeks from today, and in event of their surrender/arrest, petitioners, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each, with two sureties of like amount each, to satisfaction of learned Judicial Magistrate, First Class, Hazaribagh, in connection with Katkamsandi PS Case No.141 of 2025, subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023.
