RANCHI, India, June 17 -- Jharkhand High Court issued the following order on May 19:
1. It is very unfortunate that though the Hon'ble Apex Court has directed the parties to appear before this Court today i.e. 19.05.2025 looking to the urgency that this is a commercial appeal, but surprisingly a prayer for adjournment has been made by Mr. Piyush Poddar, learned counsel submitting that as per instruction he would be appearing in this case on behalf of the appellant by filing a fresh Vakalatnama.
2. Mr. Prashant Pallav, learned counsel for the respondent has opposed the prayer for adjournment.
3. After going through the order passed by the Hon'ble Apex Court in the Civil Appeal No. 5602 of 2025 dated 28th April, 2025, it appears that after hearing both the parties, the Hon'ble Apex Court has directed the parties to appear before this Court on 19.05.2025 and for that very reason this Special Vacation Bench has been constituted.
4. With a view to give one indulgence to the appellant, list this case on 11.06.2025. However, the appellant shall pay a cost of Rs.10,000/- to the learned counsel for the respondent.
5. It goes without saying that since the Hon'ble Apex Court has restored the case to its original file after condoning the delay; as such the registry is directed to accept the Vakalatnama proposed to be filed by Mr. Piyush Poddar, learned counsel for the appellant.
Needless to say that in view of the order passed by the Hon'ble Apex Court a cost of Rs. 25,000/- has been paid by the appellant to the respondent. Copy of receipt has been produced before this Court which has been taken on record.
