RANCHI, India, Dec. 20 -- Jharkhand High Court issued the following order on Nov. 20:
Heard the learned counsel for the respective sides.
This appeal is directed against the order dated 15.10.2025 passed in Bail Petition No. 320 of 2025 arising out of Pakur (Muffasil) P.S. Case No. 155/2023 by the learned Additional Sessions Judge-I, Pakur, whereby and whereunder, the prayer for bail of the appellant has been rejected.
It has been alleged that while the informant was taking rest along with the others, the accused persons had arrived in search of him and co-accused Anjamul Sheikh Had thrown a bomb in the house of the informant as a result of which the informant and others had sustained injures.
Submission has been advanced by the learned counsel for the appellant that the main accused Anjamul Sheikh has been granted bail by a Coordinate Bench of this Court in Criminal Appeal (DB) No. 784 of 2024. It has further been submitted that the mere presence of the appellant was noted at the place of occurrence which has resulted in his implication. It has also been stated that the appellant is in custody since 08.08.2025.
Learned Spl.PP has opposed the prayer for bail of the appellant.
Regard being had to the fact that the main accused has already been granted bail by a Coordinate Bench of this Court as noted above, we while setting aside the order dated 15.10.2025 passed in Bail Petition No. 320 of 2025 arising out of Pakur (Muffasil) P.S. Case No. 155/2023 by the learned Additional Sessions Judge-I, Pakur, direct that the appellant be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Pakur in connection with Pakur (Muffasil) P.S. Case No. 155/2023.
This appeal is allowed.
