RANCHI, India, Dec. 11 -- Jharkhand High Court issued the following order on Nov. 11:

1. Heard the parties.

2. By filing this writ petition, the petitioner has prayed to revise his pension in the grade pay of Rs. 4,200/- in place of grade pay of Rs. 2,800/-. He further prays that after such revision arrears be paid to the petitioner.

3. Learned counsel for the petitioner submits that the petitioner is entitled for the grade pay of Rs. 4,200/- and not grade pay of Rs. 2,800/-. He submits that there are Government Resolutions which supports his claim. He lastly submits that he has already filed representation before the Accountant General who is yet to decide his representation.

4. Learned counsel for the State submits that if the petitioner files a fresh representation the same can be considered.

5. Considering the submission of the parties and the issue involved in this case, I find that it is the State who has to first decide the claim and right of the petitioner.

6. Thus, I direct the petitioner to file a fresh representation before the respondent no. 2-the District Superintendent of Education who will consider the case of the petitioner. The petitioner should file fresh representation along with all the documents and circulars which he is relying in support of his claim.

7. Once the representation is filed the respondents will consider the same and pass reasoned order within the period of eight weeks from the date of receipt of the same. If the petitioner is entitled for any benefit, the same should be extended to him. If it is found that the petitioner is not entitled for any relief, the reasons thereof should be communicated to the petitioner.

8. With the aforesaid observation and direction, this writ petition is disposed of.
