RANCHI, India, Oct. 22 -- Jharkhand High Court issued the following order on Sept. 22:

1. Heard learned counsel appearing for the petitioner and learned counsel appearing for the State.

2. The petitioner is apprehending his arrest in connection with Dhanbad Cyber P.S. Case No.46/2022, registered for the offence under Sections 419/420 of the IPC and Section 66C/66D of I.T. Act, pending in the Court of the learned ADJ-II, Dhanbad.

3. Learned counsel appearing for the petitioner submits that the petitioner has been falsely implicated in the case. He further submits that the petitioner's identity has been used in creating one of the accounts in which the money has been transferred. He then submits that the petitioner is not operating the said created account and he has appeared before the I.O. and explained all the things and even the petitioner has returned the amount of Rs.9,500/- to the I.O. and I.O. has transferred the amount into the account of the victim. He next submits that the petitioner has got no criminal antecedent, which has been disclosed in paragraph 7 of this application.

4. Learned counsel appearing for the State opposed the prayer and submits that the amount was transferred in the bank account, which is in the name of the petitioner.

5. Considering that the identity of the petitioner was used in creating one of the accounts, in which, Rs.9,500/- was transferred and it has been pointed out that the petitioner is not operating the said account and he has appeared before the I.O. and filed his reply and he has got no criminal antecedent and in that view of the matter, the petitioner is directed to surrender before the learned Court within two weeks from today and the learned Court shall release the petitioner on such terms, conditions and sureties, as the learned Court may deem fit and proper.

6. Accordingly, this application is disposed of.
