RANCHI, India, Nov. 2 -- Jharkhand High Court issued the following order on Oct. 6:
1. Heard learned counsels for petitioner and for State.
2. The petitioner is apprehending his arrest in connection with Ichak PS Case No.163 of 2024, for offence registered under section 85 and 74 of BNS, 2023 and section 3 and 4 of Dowry Prohibition Act, pending in court of learned Judicial Magistrate First Class, Hazaribag.
3. Learned counsel for petitioner submits that petitioner happened to be husband of the informant and there are general and omnibus allegations of torture and demand of dowry. He then submits that prior to this case, one case was earlier registered against the brother in law and mother and in that case, mother was taken into custody and subsequently she was released on bail. He next submits that on the same allegations the present case has been lodged further.
4. Learned State counsel opposes prayer and submits that petitioner happened to be husband of the informant.
5. In view of above and considering that the petitioner happened to be husband of the informant and prior to the present case, one case was earlier lodged by the informant, and in that view of the matter, the petitioner is directed to surrender before the learned concerned court within two weeks from today, and the learned court shall release the petitioner on bail on such terms and conditions and the sureties as the learned court may deem fit and proper. 6. This petition is accordingly disposed of.
