RANCHI, India, July 19 -- Jharkhand High Court issued the following order on Jun 18:

This anticipatory bail application under Section(s) 482 and 484 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, has been preferred by the petitioner apprehending his arrest for offences registered under Section(s) 352, 308, 109, 118, 61, 351, 329 and 3(5) BNS, 2023 in connection with Chandil (Kapali) P.S. Case No. 162 of 2024, pending in the Court of learned SDJM, Chandil.

Heard the parties at length and had gone through the documents, annexed along with this application.

Counsel for the petitioner submits that the allegation against the petitioner is that he only caught hold the injured rather the allegation of assault is against one Nehal @ Nehaluddin Ansari.

Opportunity was given to the State to oppose the bail, which the State availed and opposed.

From the documents on record, I find that there is allegation that 5 persons have abused the son of the informant and assaulted him with sharp weapon and there is allegation of demand of extortion money also. From the documents it is clear that there is involvement of this petitioner in the entire occurrence and there is injury also on the victim. Even if this Court accepts the argument of the learned counsel for the petitioner that the petitioner only caught hold the son of the informant, but it cannot be lost sight that the other accused persons came and assaulted the son of the informant, and the petitioner also participated in the entire act with common intention.

In view of the aforesaid allegation, this is not a fit case for grant of anticipatory bail. Accordingly, the prayer for anticipatory bail of the petitioner, above named, is rejected.
