RANCHI, India, Dec. 24 -- Jharkhand High Court issued the following order on Nov. 24:
1. Heard learned counsel appearing for the petitioner and learned counsel appearing for the State.
2. The petitioner is apprehending his arrest in connection with Complaint Case No. 3042 of 2024, registered for the offence under Sections 308, 316, 318, 352, 97, 137, 351(1), 352(2), 351(3), 352 of BNS, pending in the Court of the learned J.M.F.C., Jamshedpur.
3. Learned counsel appearing for the petitioner submits that the petitioner happened to be the mother of the informant and the allegations has been made against the petitioner that she is not handing over the child of the informant. He submits that child was kept with the petitioner by the informant when she was four months old. He also submits that the case has been lodged against other family members also. Sister of the informant has been granted anticipatory bail by this Court in A.B.A. No. 5467 of 2025 vide order dated 17.09.2025. He submits that, if any, the case is made out that is under the Guardians and Wards Act, 1980.
4. Learned counsel appearing for the State opposed the prayer and submits that allegations are there of not returning the child of the informant.
5. Considering that there is a relationship of mother and daughter between the petitioner and the informant. Sister of the informant has been granted bail by this Court in A.B.A. No. 5467 of 2025 vide order dated 17.09.2025, I am inclined to extend the privilege of anticipatory bail to the petitioner. Accordingly, the above-named petitioner is directed to surrender before the learned Court within three weeks from today and in the event of his arrest or surrender, he will be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned J.M.F.C., Jamshedpur in connection with Complaint Case No. 3042 of 2024, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
