RANCHI, India, Dec. 24 -- Jharkhand High Court issued the following order on Nov. 24:
1. Heard learned counsel appearing for the petitioner and learned counsel appearing for the State.
2. The petitioner is apprehending his arrest in connection with Puso P.S. Case No.26 of 2025, registered for the offence under Section 69 of BNS, pending in the Court of the learned Judicial Magistrate, 1st Class, Gumla.
3. Learned counsel appearing for the petitioner submits that the false allegations are made against the petitioner. He submits that what has happened that was consensual in nature. He also submits that the petitioner and the informant were in relationship since last three years and the allegation of establishing of the relationship was further made, one year prior of the lodging of the FIR and the FIR was lodged on 22.09.2025.
4. Learned counsel appearing for the State as well as learned counsel for the informant vehemently opposed the prayer and submit that on the pretext of marriage, relationship has been established.
5. Looking into the contents of the FIR, it transpires that in FIR itself it has been disclosed that three years prior of lodging of the FIR, the relationship was established. Further relationship was established prior to one year of lodging of the FIR, whereas the FIR was lodged on 22.09.2025. Both are major and prima facie it appears that what has happened that was consensual in nature.
6. Regard being had to the facts and circumstances of the case, I am inclined to extend the privilege of anticipatory bail to the petitioner. Accordingly, the above-named petitioner is directed to surrender before the learned Court within three weeks from today and in the event of his arrest or surrender, he will be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Gumla in connection with Puso P.S. Case No.26 of2025, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
