RANCHI, India, Dec. 23 -- Jharkhand High Court issued the following order on Nov. 24:

Heard Mr. Parambir Singh Bajaj, learned counsel for the appellant and learned A.P.P. for the State.

This appeal is directed against the order dated 08.09.2025 passed by learned Additional Sessions Judge-I, Sahibganj in B.P. No.272 of 2025 arising out of Mirzachowki P.S. Case No.37 of 2025, whereby and whereunder prayer for bail of the appellant has been rejected.

It has been alleged that the appellant and Fagu Mal Pahariya were apprehended by the police and on the disclosure of Fagu Mal Pahariya, seven country made musket rifles were recovered.

Submission have been advanced on behalf of learned counsel on behalf of appellant that the appellant is in custody since 10.06.2025. It has further been submitted that the recovery was effected from the house of Fagu Mal Pahariya. Learned counsel for the appellant submits that the appellant has been implicated merely on the account of his presence at the place of occurrence.

Learned A.P.P. has opposed the prayer for bail of the appellant.

Regard being had to the fact that recovery has been effected from the house of Fagu Mal Pahariya, we while setting aside the order dated 08.092025 passed by learned Additional Sessions Judge-I, Sahibganj in connection with B.P. No.272 of 2025 arising out of Mirzachowki P.S. Case No.37 of 2025, direct that the appellant be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Court below.

This appeal is allowed.
