RANCHI, India, June 8 -- Jharkhand High Court issued the following order on May 8:
1. PMs. Talat Parveen, the learned counsel has appeared on behalf of the respondent no.7 through the Video Conferencing (V.C).
2. One of the points in the appeal which has been taken is of contributory negligence on the part of the deceased.
3. The learned counsel for the claimants (respondent nos.1 to 4) submits that the accident took place on 25.12.2025 and submits that till date, not even a single farthing has been paid in terms of the Award to the claimants. She submits that, however, in view of the co-ordinate Bench order of this Court dated 23.9.2024, the entire amount has been deposited by the insurance company before the learned court.
4. In view of above and considering that the only point appears is of contributory negligence on the part of the deceased and the claimants have not been paid as yet anything in terms of the Award as pointed out by the learned counsel appearing for the claimants, and in that view of the matter, the learned Tribunal will release 50% of the awarded amount in favour of the claimants on proper verification.
5. So far as the rest of the amount is concerned, that will be subject to the appeal.
6. Let this appeal be placed on 09.07.2025.
