RANCHI, India, Feb. 14 -- Jharkhand High Court issued the following order on Jan. 13:
1. Heard learned counsel appearing on behalf of Petitioner and learned counsel appearing on behalf of the State.
2. The petitioner is apprehending his arrest in connection with Chainpur P.S. Case No.44 of 2025, for the offences registered under Sections 274 /292 of BNS, 2023, and under Section 47(a) of Excise Act, pending in the Court of learned Judicial Magistrate, 1st Class, Gumla.
3. Learned counsel appearing for the petitioner submits that allegations are made that foreign liquors have been recovered from the hotel of the petitioner. He further submits that the petitioner was not present in hotel. He also submits that in the seizure list, there is no independent witness.
4. Learned counsel appearing for the State opposed the prayer and submits that recovery of liquor is from the hotel of the petitioner.
5. Considering that the petitioner was not present at the spot and the seizure was made in absence of the petitioner and in the seizure list, there is no independent witnesses. In that view of the matter, the petitioner above named is directed to surrender before the learned Court within two weeks and the learned Court shall release the petitioner on such terms and condition or sureties, the learned Court may deem fit and proper.
6. This Anticipatory Bail Application is accordingly disposed of.
