RANCHI, India, July 7 -- Jharkhand High Court issued the following order on June 6:
Heard the learned counsel for the respective sides.
This appeal is directed against the order dated 11.12.2024 passed in Misc. Cr. App. No. 1606 of 2024 by the learned Additional Sessions Judge-I at Chatra in ST No. 111 of 2023, whereby and whereunder, the prayer for bail of the appellant has been rejected.
It has been alleged that pamphlets and posters were pasted on behalf of the banned organization TSPC for realization of levy and extending threats to the crusher owners.
Submission has been advanced by the learned counsel for the appellant that the appellant is in custody since 03.03.2021. It has further been submitted that several co-accused persons similarly situated have been granted bail by this Court in Cr. Appeal (DB) No. 1443 of 2022 and Cr. Appeal (DB) No. 1179 of 2023.
Learned Spl.P.P. has opposed the prayer for bail of the appellant and has submitted that the appellant has got twenty-five criminal antecedents.
However, regard being had to the nature of allegations levelled against the appellant and considering the fact that several co-accused persons have been granted bail by this Court, we while setting aside the order dated 11.12.2024 passed in Misc. Cr. App. No. 1606 of 2024 by the learned Additional Sessions Judge-I at Chatra in ST No. 111 of 2023 direct the appellant be released on bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-I at Chatra in ST No. 111 of 2023.
This appeal is allowed.
