RANCHI, India, Dec. 31 -- Jharkhand High Court issued the following order on Dec. 1:

1. Heard the parties.

2. The petitioner prays for the following reliefs:

a. To direct the concerned respondents to immediately and forthwith pay the petitioner his arrears of salary under promoted post of Draft man Grade-II from 01.10.2024 (the date when he joined the promoted post of draftman Grade-II) to 02.02.2025 (the date, when he superannuated under the pay scale of Rs. 4000-100- 6000, pay band of Rs. 5200-20,200/-

b. To direct the concerned respondents to pay the petitioner following retiral benefits along with statutory and penal interest, after fixing his last pay drawn on the basis of aforesaid pay scale of Rs. 4000-100-6000/- and grade pay of Rs. 5200-20200/-:- pension, gratuity, leave encashment, benefits of earned leave, travelling allowance, other admissible retiral dues.

3. It is his contention that no retiral benefit has been paid to him and he is also entitled for the salary and higher scale.

4. Learned counsel appearing on behalf of the respondents submits that the claim of the petitioner first needs to be decided by the respondents, thus, if the petitioner files a fresh representation before respondent no. 3-Executive Engineer, Kharkhai Kanal Division, his case will be considered.

5. Considering the submission of the parties, I direct the petitioner to file a fresh representation before the respondent no. 3- Executive Engineer, Kharkhai Kanal Division, who will consider the case of the petitioner.

6. The representation should be filed within four weeks and the decision should be taken within eight weeks thereafter.

7. If it is found that the petitioner is entitled for any benefits the same should be extended to the petitioner. If the claim of the petitioner is rejected for any reasons whatsoever the reasons thereof should be communicated to the petitioner within a period of two weeks thereafter.

8. With the aforesaid observation and direction, this writ petition is disposed of.
