RANCHI, India, July 19 -- Jharkhand High Court issued the following order on Jun 19:
1. Heard the parties.
2. This anticipatory bail application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, has been preferred by the petitioner apprehending his arrest for offences under Sections 413, 419, 420, 467, 468, 471 and 120(B) IPC and Sections 66B, 66C, 66D of I.T. Act.
3. Learned Spl. P.P. representing the State opposes the prayer for anticipatory bail.
4. Two persons namely Prem Prakash Das and Sanjay Ravi Das were apprehended as they had committed cyber crimes. The name of this petitioner transpired from the confessional statement of these two persons after they were arrested.
5. Counter affidavit has been filed by the State in this case. In para-13 of the Counter Affidavit filed by the State sworn by Sub Inspector of Police, East Tundi Police Station, it has been stated that the independent witnesses stated that due to enmity, the apprehended accused persons have taken the name of Kishore Das (petitioner herein) and further Kishore Das has got no criminal antecedent as per the ICGS portal.
6. Considering the aforesaid statement made in the counter affidavit, I am inclined to grant anticipatory bail to this petitioner.
8. Accordingly, this Anticipatory Bail Application stands allowed. The petitioner, above named, is directed to surrender before the learned court below within four weeks from the date of receipt of copy of this order and on the event of his surrender or arrest, he shall be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand), with two sureties of the like amount each, to the satisfaction of learned Additional Sessions Judge, IInd-cum-Special Judge, Dhanbad, in connection with Purvi Tundi P.S. Case No.18 of 2024, subject to the condition that one of the bailers should be a close relative of the petitioner and other should be a resident of State of Jharkhand, having sufficient landed property in his name or in the name of his ancestors in which he is having share and to that effect, he has to file an affidavit before the Trial Court indicating his share in the property. The petitioner will cooperate in the investigation and will appear before the Investigating Officer as and when directed.
