RANCHI, India, Nov. 18 -- Jharkhand High Court issued the following order on Oct. 17:

Heard the learned counsel for the respective sides.

This appeal is directed against the order dated 02.09.2025 passed by the learned Additional Sessions Judge-I, Bermo at Tenughat (Bokaro) in Bail Petition No. 137 of 2025 arising out of Bermo P.S. Case No. 79/2025, whereby and whereunder, the prayer for bail of the appellant has been rejected.

It has been alleged that a raid was conducted by the police and it was found that an illegal gun factory was being run.

Submission has been advanced by the learned counsel for the appellant that one of the main accused, Suraj Kumar Saw has been granted bail by this Court in Filing No. Criminal Appeal (DB) 23150 of 2025. Learned counsel submits that the appellant is in custody since 20.06.2025 and in fact he was merely a labour in the said gun factory. Learned counsel adds that the charge sheet has been submitted against the appellant.

Learned APP has opposed the prayer for bail of the appellant.

On consideration of the fact that one of the main accused has been granted bail by this Court and the appellant being merely a labour who was apprehended from the said factory, we while setting aside the order dated 2.09.2025 passed by the learned Additional Sessions Judge-I, Bermo at Tenughat (Bokaro) in Bail Petition No. 137 of 2025 arising out of Bermo P.S. Case No. 79/2025, direct that the appellant be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Tenughat in connection with Bermo P.S. Case No. 79/2025.

This appeal is allowed.
