RANCHI, India, Feb. 9 -- Jharkhand High Court issued the following order on Jan. 9:
1. Heard the parties.
2. The present writ petition has been filed for following reliefs:-
"i. For quashing the entire proceeding of H.R.C. Case No. 125/2024 pending before the respondent no.5 when ownership dispute is pending before this Hon'ble Court when State is the paramount landlord of the Dhalbhum Raja Market situated in Jugsalai, Jamshedpur and rent has been deposited in the treasury as per order of the respondent no. 3.
ii. For stay of the further proceeding of H.R.C. Case No. 125/2024 pending before the respondent no. 5, during the pendency of instant writ petition when respondent no. 5 has no jurisdiction to entertain the application under the Building Act."
3. It has been submitted by the learned counsel for the petitioner that the preliminary issue has been raised regarding the maintainability of the proceeding.
4. In that view of the matter, no notice is required to be issued upon the private respondent.
5. The adjudicator is directed to decide the preliminary issue raised in H.R.C Case No.125 of 2024, after giving due opportunity to the parties.
6. With the above observation and direction, the present writ petition stands disposed of.
