RANCHI, India, Feb. 22 -- Jharkhand High Court issued the following order on Jan. 20:

Heard Mr. Akhouri Awinash Kumar, learned counsel for the appellant and learned Spl. P.P.

This appeal is directed against the order dated 09.10.2025 passed by the learned Additional Sessions Judge-I, Giridih in M.C.A. No. 1946/2025 in connection with Nimiaghat P.S. Case No. 50/2020, whereby and whereunder, the prayer for bail of the appellant has been rejected.

It has been alleged that one Prakash Marandi was kidnapped by the members of the organization Jan Maleshiya.

Submission has been advanced by the learned counsel for the appellant that the appellant has been implicated only on account of the vague disclosure made by the villagers. It has been submitted that the appellant is in custody since 07.02.2025.

Learned Spl. P.P. has opposed the prayer for bail of the appellant and has submitted while going through the case diary that the victim has not yet been recovered.

It appears that no specific allegation has been levelled against the appellant of kidnapping Prakash Marandi and only on the basis of some ambiguous statements made by the villagers implicating the present appellant and the other accused persons, he has been made an accused.

On consideration of the aforesaid facts, we while setting aside the order dated 09.10.2025 passed by the learned Additional Sessions Judge-I, Giridih in M.C.A. No. 1946/2025 in connection with Nimiaghat P.S. Case No. 50/2020 direct that the appellant be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-I, Giridih.

This appeal is allowed.
