This application has been preferred by the appellant for condoning a delay of 23 days in filing the appeal.

Having been satisfied with the reasons assigned in this application, the delay of 23 days which had occurred in filing this appeal is condoned and this I.A. is allowed and disposed of.

Criminal Appeal (DB) No. 187 of 2026

Heard the learned counsel for the respective sides.

This appeal is directed against the order dated 16.10.2025 passed by the learned Additional Sessions Judge-I, Giridih in Misc. Criminal Application No. 2034 of 2025 (S.T. No. 85 of 2024) arising out of Sariya P.S. Case No. 63/2017, whereby and whereunder, the prayer for bail of the appellants has been rejected.

It has been alleged that some extremists are involved in planting some explosive devices in the railway line and they were seen by the village security committee members. Subsequently on an information, the police had arrived and some incriminating articles were seized from the place of occurrence.

Submission has been advanced by the learned counsel for the appellants that the appellants are in custody since 16.10.2023. It has further been submitted that the incident had occurred in the night and therefore there is a clear doubt with respect to the identification of the appellants by the village security committee members.

Learned Spl.PP has opposed the prayer for bail of the appellants and has submitted that both the appellants have criminal antecedents.

Regard being had to the manner of implication of the appellants and the period of custody undergone by them, we while setting aside the order dated 16.10.2025 passed by the learned Additional Sessions Judge-I, Giridih in Misc. Criminal Application No. 2034 of 2025 (S.T. No. 85 of 2024) arising out of Sariya P.S. Case No. 63/2017, direct that the appellants be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-I, Giridih in connection with S.T. No. 85 of 2024 arising out of Sariya P.S. Case No. 63/2017.

This appeal is allowed.
