RANCHI, India, May 29 -- Jharkhand High Court issued the following order on April 29:
1. No one appears on behalf of the petitioner.
2. Learned counsel for the State is present.
3. I have gone through the petition and considering the nature of the prayer made in the petition and submission made therein, I am not inclined to keep this matter pending.
4. By filing this writ petition, the petitioner has prayed for a direction upon the respondents to resume issuance of the rent receipt after accepting rent of the land measuring total area of 1.28 acres under Khata No. 2, Plot No. 828 (0.83Acre) and Plot No. 805 (0.45 Acre) situated in Village-Marcha, P.S.-Khunti, Dist.-Khunti.
5. It is the case of the petitioner that arbitrarily, the rent is not being accepted of the said land and receipt has also not been issued in favour of the petitioner.
6. It is the claim of the petitioner that land was allotted in favour of father of the petitioner for the purpose of residence and cultivation under the Bhoodan Yogna Scheme, though the page 15 of the writ petition says otherwise.
7. Be that as it may, considering the nature of the prayer made by the petitioner, I direct the petitioner to approach the respondent No.3- Deputy Commissioner, Khunti, for his grievance, who will consider the same.
8. If he is of the opinion that the rent should be accepted from the petitioner, he will pass an appropriate order. If the claim of the petitioner is rejected, the order to that effect should be communicated to the petitioner.
9. Accordingly, this writ petition stands disposed of.
