RANCHI, India, Nov. 2 -- Jharkhand High Court issued the following order on Oct. 6:

1. Heard learned counsel appearing for the petitioner and learned counsel appearing for the State.

2. The petitioner is apprehending his arrest in connection with Complaint Case No.44/2021, registered for the offence under Section 33(c) of the Indian Forest Act, pending in the Court of the learned Sub-Divisional Judicial Magistrate, Chatra.

3. Learned counsel appearing for the petitioner submits that the allegations are made that the petitioner and other persons were ploughing 1 acre of land of the Forest Department for cultivation of poppy plants. He further submits that false allegations are made and even the land is not of the petitioner. He then submits that the petitioner is having no criminal antecedent, as disclosed in paragraph 17 of this application.

4. Learned counsel appearing for the State opposed the prayer and submits that the allegations are there of ploughing on the Forest Department's land for cultivation of poppy plants.

5. Considering that the petitioner has got no criminal antecedent and even the land is not belonging to the petitioner and that is of the Forest Department and in the attending facts and circumstances of the case, I am inclined to extend the privilege of anticipatory bail to the petitioner.

6. Accordingly, the above-named petitioner is directed to surrender before the learned Court within three weeks from today and in the event of his arrest or surrender, he will be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Chatra in connection with Complaint Case No.44/2021, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
