RANCHI, India, March 2 -- Jharkhand High Court issued the following order on Jan. 30:

1. Heard Ms. Neha Kumari, learned counsel for the appellant and learned A.P.P.

2. This appeal is directed against the order dated 27.11.2025 passed by the learned Additional Sessions Judge-I, Latehar in Misc. Criminal Application No. 815 of 2025, arising out of Latehar P.S. Case No. 236/2021, whereby and whereunder, the prayer for bail of the appellant has been rejected.

3. It has been alleged that there was an exchange of firing between the police personnel and the extremists of JJMP, as a result of which, one of the police personnel had suffered injury on his shoulder. The extremists however subsequently managed to flee away and on search, the dead body of a JJMP extremist was found at the place of occurrence.

4. It has been submitted by learned counsel for the appellant that the name of appellant has come on a secret information.

5. Learned counsel submits that in similar circumstances, some of the co-accused have been granted bail in Cr. Appeal (DB) No. 864 of 2022 and Cr. Appeal (DB) No. 209 of 2023.

6. Learned counsel adds that the appellant is in custody since 10.03.2025.

7. Learned A.P.P. though has opposed the prayer for bail of the appellant, but has not disputed that the case of the present appellant is similar to those co-accused, who have been granted bail.

8. Regard being had to be above, we, while setting aside the order dated 27.11.2025 passed by the learned Additional Sessions Judge-I, Latehar in Misc. Criminal Application No. 815 of 2025, arising out of Latehar P.S. Case No. 236/2021, direct that the appellant be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-I, Latehar in connection with Latehar P.S. Case No. 236 of 2021, G.R. No. 512 of 2025 (S) (S.T. No. 234 of 2025).

9. This appeal is allowed.
