RANCHI, India, June 11 -- Jharkhand High Court issued the following order on May 15:

1. Heard Mr. Kripa Shankar Nanda, learned counsel for the petitioner and Mr. Shailesh Kr. Sinha, learned A.P.P. appearing for the State.

2. Petitioner has been made accused in connection with S.T. Case No. 344/2013 arising out of Kamdara P.S. Case No. 06 of 2012 (G.R.Case No. 147/2012) for the offences registered under Section 302, 201, 34 of the IPC and under Section 27 of Arms Act and under Section 17 of CLA Act.

Record reveals that this petitioner was admitted to regular bail on earlier occasion, however, he jumped the condition of bail and thereafter even issuance of coercive process, he could not be apprehended and later on, he has been remanded in the present case on 11.02.2025 from other case at the behest of the petitioner. Learned counsel for the petitioner urged that on account of petitioner being illiterate and as he had gone to Gujarat to earn his livelihood, therefore, he could not appear in the present matter and at the same breath, learned counsel for the petitioner undertakes that petitioner shall make himself present before the trial Court on each and every date of hearing.

4. Learned A.P.P. for the State has opposed the prayer for bail on the premise that without plausible reason concession of bail was misused by the petitioner for six years.

5. Considering the totality of aforesaid facts and circumstances, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs. 25,000/- (Rupees twenty five thousand), with two sureties of the like amount each, to the satisfaction of learned Additional Sessions Judge, Gumla in connection with S.T. Case No. 344/2013 arising out of Kamdara P.S. Case No. 06 of 2012 (G.R.Case No. 147/2012), with a condition that petitioner shall appear on each and every date of hearing except medical exigency and for medical exigency, he shall have to produce medical prescription/paper from government hospital before the Court for seeking his exemption from personal appearance; otherwise Court shall pass necessary order for non-compliance of bail order.
