RANCHI, India, April 18 -- Jharkhand High Court issued the following order on March 17:

Heard Mr. Jitendra S. Singh, learned counsel for the appellant and learned P.P. for the State.

This appeal is directed against the order dated 15.01.2026 passed by the learned Additional Judicial Commissioner-VII-cum-Special Judge, CBI (AHD scam), Ranchi in A.B.P. No. 3585 of 2025, arising out of Ormanjhi P.S. Case No. 210 of 2025, whereby and whereunder, the prayer for bail of the appellant has been rejected.

It has been alleged that a raid was conducted on an information that there was some illegal storage of explosives in a secluded house in village Piska, Ormanjhi and consequent to the raid in that particular house huge quantity of Gelatine sticks, red color wires and detonators were recovered.

Submission has been advanced by the learned counsel for the appellant that there is nothing to indicate that the house from where such explosive substances were recovered belong to the appellant. Learned counsel submits that in course of investigation none of the witnesses have come forward to state about the involvement of the appellant in keeping the explosive substances. In fact, the appellant has a separate dwelling house and he is not at all concerned with the house from where the explosive substances were recovered.

Learned P.P. has opposed the prayer for anticipatory bail of the appellant and on going through the case diary has submitted on the condition of anonymity some of the persons have stated that the house in question belong to the appellant. He has admitted that save and except the said disclosure there is nothing on record to indicate that it was the appellant who has stored the explosive substances.

Regard being had to the aforesaid facts, we while setting aside the order dated 15.01.2026 passed by the learned Additional Judicial Commissioner-VII-cum-Special Judge, CBI (AHD scam), Ranchi in A.B.P. No. 3585 of 2025, arising out of Ormanjhi P.S. Case No. 210 of 2025, direct the petitioner to surrender before the learned court below within a period of four weeks and on his surrender, he shall be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand only) with two sureties of the like amount each to the satisfaction of learned Additional Judicial Commissioner-VII-cum-Special Judge, CBI (AHD scam), Ranchi in connection with Ormanjhi P.S. Case No. 210 of 2025, subject to the conditions as laid down under Section 482(2) of the B.N.S.S., 2023.

This appeal stands allowed.
