RANCHI, India, March 19 -- Jharkhand High Court issued the following order on March 17:

1. Heard the parties.

2. The present writ petition has been filed for the following reliefs:-

"i. For quashing the order dated- 29.05.2005 (Annexure- 20) issued by the District Cooperative Officer, Giridih in view of the order dated- 06.03.2025 passed in WP(C) no. 46 of 2025 through which the said authority in a most illegal and arbitrary and violation of the Principles of Natural Justice and in utter disregard to several relevant facts and government rules/resolutions stated by the petitioner with respect to his claims and grievances, rejected the claims of the petitioner and directed the petitioner to ensure delivery/ transportation of balance 1570. 60 quintiles of rice to the mill.

ii. For issuance of an appropriate direction upon the respondent no.-2 to conduct proper, transparent and impartial enquiry regarding the procurement of the paddy by the petitioner, lifting and transportation of Paddy by the miller and the act/conduct of the miller towards to the petitioner regarding non-giving of receipts of quantities of Paddy transported by them and lastly the role of the local officials in the entire affair who in connivance and in conspiracy with the miller are trying to held the petitioner responsible for the illegalities, while considering the facts: -

a. Jaruadih PACS, Giridih in which the petitioner is a manager was attached with respondent no.- 08 (Miller) for Kharif marketing season 2023-24.

b. The respondent no.- 08 through trucks transported 1900 qt. of paddy to his mill and when the petitioner demanded the receipts from the mill owner, (respondent no. 08) he avoided giving the same on the pretext of advance CMR and when these facts brought to the notice of the official respondents, nothing has been done till date.

iii. The petitioner further prays for a direction upon the respondents, specially JSFC to ensure complete payment of cost of the paddy to ten farmers who have not been paid the full amount till date and other 17 farmers having paid only the first part of installment, the 2nd part of installment has not been paid yet which is violative of the government resolution and those farmers from whom the petitioner took the paddy have been giving regular threatening to the petitioner on account of non-payment of said amount to them.

iv. The petitioner also prays for a direction upon the respondents, restraining them from taking any action harassing the petitioner while considering the fact that the respondent no.- 06 and 07 at the instance of the respondent no.- 08 have been giving threat to the petitioner that they will put the petitioner PACS in black list and further the PACS may not be allowed to collect Paddy for the further Kharif marketing seasons.

v. The petitioner further prays for a diction upon the respondents authorities to select then for the Kharif marketing season 25-26 since the petitioner for the Kharif marketing season 24- 25 who was not selected for procurement of Paddy."

3. After some argument, learned counsel for the petitioner seeks permission to withdraw the present writ petition with a liberty to approach the concerned District Level Committee and work out his remedy in accordance with law.

4. Permission is accorded.

5. Accordingly, the present writ petition stands disposed of with the aforesaid liberty.
