RANCHI, India, Sept. 7 -- Jharkhand High Court issued the following order on Aug. 7:

1. The present writ petition has been filed for following relief:-

"for issuance of appropriate writ (s), order(s), direction(s), commanding upon the respondents to provide the certified copies of the Khatiyans (Parcha) of Jamabandi No. 50 of Mouza Birniya, No. 148 and Jamabandi Nos. 27 & 29 of Mouza Prandih, Banusare No. 161-155, both P.S. Devipur (earlier Jasidih), District Deoghar to the petitioner forthwith."

2. Learned counsel for the petitioner submits that the petitioner has unfortunately passed away. However, it is contended that the cause of action survives. In view thereof, learned counsel seeks permission to withdraw the present writ petition with liberty to file a fresh writ petition, if so desired, by the legal heir(s) of the deceased petitioner.

3. In view of above submission, the present writ petition is hereby dismissed as withdrawn with aforesaid liberty.
