RANCHI, India, Aug. 25 -- Jharkhand High Court issued the following order on July 25:
Heard Mr. Gautam Kumar, learned counsel for the appellant and Mrs. Kumari Rashmi, learned A.P.P.
This appeal is directed against the order dated 21.06.2025 passed by the learned Additional Sessions Judge-I, Pakur in B.P. No. 188/2025 in connection with Pakur (Malpahari O.P.) P.S. Case No. 154/2024, whereby and whereunder, the prayer for bail of the appellant has been rejected.
It has been alleged that when the informant was returning along with her husband, the accused persons including the present appellant had accosted her husband, committed assault upon her and when the informant went to the village and came back with some of the villagers, bombs were also thrown and firing was made. The husband of the informant later on died.
It has been submitted by the learned counsel for the appellant that the allegations are general and omnibus in nature. It has further been submitted that on consideration of the said allegation, a Co-ordinate Bench of this Court has already granted bail to several accused persons in Cr. Appeal (DB) No. 1485 of 2024 and Cr. Appeal (DB) No. 1492 of 2024. It has been submitted that the appellant is in custody since 10.06.2025.
Learned A.P.P. though has opposed the prayer for bail of the appellant, but has not disputed the aforesaid facts.
Regard being had to the fact that the case of the appellant stands on a similar footing to those accused who have already been granted bail as noted above, we, while setting aside the order dated 21.06.2025 passed by the learned Additional Sessions Judge-I, Pakur in B.P. No. 188/2025 in connection with Pakur (Malpahari O.P.) P.S. Case No. 154/2024, direct that the appellant be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Pakur in connection with Pakur (Malpahari O.P.) P.S. Case No. 154/2024.
This appeal is allowed.
