RANCHI, India, Feb. 14 -- Jharkhand High Court issued the following order on Jan. 13:
Bail petition filed on behalf of the petitioner- Manish Kumar, who is in custody since 06.07.2025 in connection with Namkum P.S. Case No. 209 of 2025 for the offence registered under Sections 318(4), 308(6), 127(3), 126(2), 115(2), 352, 351(2), 111(2b), 111(3) and 61(2) of Bhartiya Nyaya Sanhita, 2023 pending in the Court of learned Judicial Magistrate, Ranchi, is pressed into motion.
As per the FIR, the allegation is of defrauding the informant for a sum of Rs.31,000/- on a false promise to provide private employment in a private sector concern.
It is submitted by the learned counsel on behalf of petitioner that as a matter of fact the informant was engaged as a Salesman in which he was handed over certain products of the said Company which was neither sold nor sale proceeds were refunded and when it was demanded to be returned, instant case has been lodged. It is contended that criminal proceedings cannot be used for recovery of money.
Learned A.P.P. opposed the bail petition.
Considering the allegation and materials on record, the above-named petitioner is directed to be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the Court below.
