RANCHI, India, Oct. 25 -- Jharkhand High Court issued the following order on Sept. 25:
1. The appellant had approached the Writ Court for grant of the following substantial reliefs:-
"For the issuance of an appropriate writ(s)/rule(s)/direction(s) especially in the nature of Mandamus for directing the respondent authorities to take immediate steps to consider the tender document submitted by the petitioner and gets the documents/Qualification of the tenderers verified by any independent agency.
And/Or
For quashing the grant of the tenders if the same has already been given to any person."
2. It has specifically come in the counter affidavit filed on behalf of the SAIL that the entire documents submitted by respondent no.6, in whose favour the tender has been allotted, were verified and found to be genuine and, therefore, it did not require further verification.
3. It is precisely on this ground that the learned Writ Court dismissed the petition observing that it was not the job of the Writ Court to verify the documents once accepted by the authority which alone was competent to accept the same in the tendering process unless and until something extraordinary would come up before the Court, which was not the factual situation appearing in the instant lis.
4. Obviously, in such circumstances, this appeal sans merits. Additionally, we also noticed that the tender in question was floated in the year 2016 and was for a period of three years and it is represented by the respondents-SAIL that the work already stands completed. Obviously, in such circumstances also, the appeal is otherwise rendered infructuous.
5. For all the reasons stated above, the appeal is ordered to be dismissed.
6. Pending application(s), if any, shall also stand closed.
