RANCHI, India, Jan. 6 -- Jharkhand High Court issued the following order on Dec. 5:

1. Heard Mr. Ashok Kumar Sinha, No.4, learned counsel for the appellant and learned A.P.P. for the State.

2. This appeal is directed against the order dated 22.09.2025 passed by the learned Additional Judicial Commissioner-XVIII-cum-Spl. Judge ATS, Ranchi in M.C.A. No.1725 of 2025 arising out of A.T.S. P.S. Case No.02 of 2024/ ATS Court Case No.06 of 2024, whereby and whereunder, the prayer for bail of the appellant has been rejected.

3. It has been alleged that one Vikash Kumar was apprehended by the police and from his possession, one country made pistol was recovered. On the confession made by the said Vikash Kumar, the houses of several other accused persons were searched and various incriminating articles were recovered.

4. It has been submitted by learned counsel for the appellant that the appellant has been implicated on the confession of the apprehended accused, Vikash Kumar. It has further been submitted that from the possession of the appellant, one stolen motorcycle was recovered. Learned counsel adds that several co-accused persons including Vikash Kumar have been granted bail by the Co-ordinate Bench of this Court. Learned counsel submits that the appellant is in custody since 19.07.2025.

5. Learned A.P.P. has opposed the prayer for bail of the appellant.

On consideration of the manner of the implication of the appellant and the fact that several co-accused persons have been granted bail as noted above, we, while setting aside the order dated 22.09.2025 passed in M.C.A. No.1725 of 2025 arising out of A.T.S. P.S. Case No.02 of 2024 corresponding to ATS Court Case No.06 of 2024, direct the appellant be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Ranchi.

7. This appeal is allowed.
