RANCHI, India, Sept. 17 -- Jharkhand High Court issued the following order on Aug. 18:

1. The petitioner is claiming revision of his pension and payment of arrears thereafter.

2. It is his claim that after adoption of report of 6 th and 7th Pay Commission, pension of the petitioner has not been revised nor the arrears have been paid. He further submits that the petitioner has superannuated on 30.04.2001 from Dudhimati Primary School, Chandwa as the Assistant Teacher.

3. His contention is that he has filed his representation before the respondents but the same is not considered.

4. Learned counsel appearing on behalf of the State submits that if the petitioner files a detailed fresh representation before the respondent no. 3-District Superintendent of Education, Latehar, his case will be considered and an appropriate order will be passed. If the petitioner is entitled for any relief the same will be extended to him.

5. Considering the submission of the parties, I direct the petitioner to file a fresh representation before the respondent no. 3-District Superintendent of Education, Latehar who will consider the case of the petitioner.

6. The representation should be filed within four weeks and the decision should be taken within eight weeks thereafter.

7. If it is found that the petitioner is entitled for any monetary benefits the same should be extended to the petitioner. If the claim of the petitioner is rejected for any reasons whatsoever the reasons should be communicated to the petitioner within a period of four weeks thereafter.

8. With the aforesaid observation and direction, this writ petition is disposed of.
